SECTION GUIDE

What is the Fair Work Agency?

The Fair Work Agency is the new UK employment enforcement body for employment rights, officially launched on 7th April 2026.

It brings together multiple existing enforcement organisations into one central authority, making it easier for both employees and employers to understand, access, and comply with workplace laws.

  • What does the Work Work Agency do?

The Fair Work Agency is responsible for enforcing key areas of employment law, including:

    It has the authority to:

    • Investigate businesses
    • Carry out workplace inspections
    • Issue penalties for non-compliance
    • Take legal action against employers
    • Recover unpaid wages on behalf of workers
  • Why was the Fair Work Agency introduced?

The UK Government introduced the Fair Work Agency as part of wider employment law reforms under the Employment Rights act.

    The key goals are to:

    • Strengthen enforcement of existing employment rights
    • Protect valuable workers from exploitation
    • Simplify what was previously a fragmented enforcement system

For many businesses, this marks a shift from reactive enforcement to a more proactive and visible regulatory approach.

  • What has changed for employers?

While the Fair Work Agency does not create new employment rights, it significantly changes how those rights are enforced.

    Employers can expect:

    • More coordinated inspections across different areas of compliance
    • Increased scrutiny of payroll practices
    • Greater focus on record-keeping and documentation
    • Faster enforcement action where issues are identified
  • What should employers do now?

To stay compliant under the Fair Work Agency, employers should:

    • Review payroll processes to ensure correct pay calulations
    • Check holiday pay and statutory entitlements
    • Maintain accurate and accessible employee records
    • Ensure contracts and policies are up to date
    • Train managers on employment law basics
    • Conduct regular internal audits
  • Who does the Fair Work Agency apply to?

The Fair Work Agency applies to most employers across the UK, regardless of size or sector.

It is particularly relevant for businesses with:

    • Complex pay structures
    • Part-time, casual, or agency workers
    • High staff turnover
    • Limited HR support or internal compliance processes
  • Is the Fair Work Agency something to worry about?

Not if your business is already complaint. For employers who follow best practice, the Fair Work Agency should provide:

    • Clearer guidance
    • Easier access to support
    • More consistency in enforcement

However for businesses with gaps in compliance, it introduces a higher risk of investigation and penalties.
